Filing for Workers' Compensation

The process of filing a workers' compensation claim and working toward a successful resolution is one in which the majority of employees and employers can become frustrated and confused. Our lawyers have experience explaining the process and challenges to clients in an effort to alleviate their frustrations, while moving forward.

The Tampa workers' compensation claims attorneys at Petruccelli Mason, LLP have more than 18 combined years of experience helping clients. Additionally, Mr. Petruccelli has several years of experience working in insurance defense in workers' comp cases. This knowledge gives our firm unique insight into the tactics and strategies of both sides of the dispute.

Notify Your Employer

It is important to notify your employer of a workplace accident within 30 days. This notification should be made in writing and include a complete description of the accident, and an accurate list of all body parts that were hurt. You should request copies of all documentation that your employer asks you to fill out. Employers should report the accident immediately to the insurance carrier and document all information about the injury.

If there is a dispute as to benefits for medical or lost wages one may file a Petition for benefits with the workers' compensation court. That will be the start of the lawsuit. On your behalf, we will address the specific petition requests to make sure the appropriate benefits are provided. We also work to ensure you get the proper lost wages calculations.

These types of cases can go on for a lengthy amount of time. The court will set a trial date on an issue within 210 days of receipt of the petition. Normally, the process is quicker — but not all the time. Often, we can attain a resolution on a benefit dispute without the need for a final hearing. This can be accomplished through negotiation and mediation. By working with all parties together, it is common to reach a beneficial settlement agreement that can potentially shorten the case's duration by a great deal. Contact our firm with questions about the petition process or a more thorough discussion about your injury.
