Many parties prefer mediation as a form of dispute resolution. Mediation gives each party a say in the resolution without turning the entire decision over to a judge. Typically, mediation has a shorter duration than a trial, causing parties to expend less time and money while working toward a beneficial conclusion.
Mediation is a confidential, informal process by which parties attempt to resolve the issues at hand, or the entire case as a whole, without any hearing before a judge. It is considered a voluntary process for resolution in the sense that the parties can resolve issues, if they agree to the resolution. If an agreement cannot be reached, the matter is then taken to court.
Mediation is mandated by statute where a petition is filed. Before the dispute reaches a judge, the parties must go through the process.
