Typically, employees are entitled to lost wages if they are taken out of work entirely by an authorized physician, or are provided restrictions to return to work and the employer is unable to accommodate those restrictions. In these situations, the employee might be eligible to receive workers' compensation lost wage benefits.
- Temporary partial disability benefits: If you have not reached maximum medical improvement, you might be able to receive temporary partial disability benefits. Or, if you return to work and receive less than your full pay, you might be entitled to these benefits. There are significant calculations involved, including restrictions, your situation, and your current and past earnings.
- Temporary total disability benefits: If you are taken totally out of work on a temporary basis you may be entitled to lost wage benefits up to 66 and 2/3 of your average pay.
- Permanent total disability benefits: If you cannot return to work, and you can show certain statutory criteria that you are totally disabled, you might be entitled to receive permanent total disability benefits. These benefits are paid if an individual reaches the maximum medical improvement and cannot return to employment.
