I've been served with a summons and complaint for foreclosure, what do I do now?

You must take immediate action to defend the legal action brought against you or you may waive all of your rights to defend against a foreclosure. Because Florida law provides you only 20 days to respond to the complaint, you should contact a foreclosure defense attorney immediately to protect your rights. I haven't been sued yet, what can you do for me?

Just because a foreclosure action hasn't been filed against you, doesn't mean that we may not be able to help you. If you are currently behind on you mortgage payments, it is only a matter of time before the lender will seek to foreclose on your property. We engage your lender prior to a foreclosure action and begin negotiations with your lender to modify your loan, process a short sale or other remedies. Through our representation, we can often delay a foreclosure action while we explore other options with your lender.

Can the bank sue me for anything else after they take my house?

This is a common question that we hear and clients are often surprised when we tell them that the lender can pursue a judgment against them after their home is sold at a foreclosure sale. If the foreclosure sale results in the sale amount being less than what is owed the lender, the lender may then pursue a deficiency judgment against the borrower for the difference between these amounts. Unfortunately, in this economic climate, foreclosure sales almost always result in a deficiency, often in excess of a hundred thousand dollars, which may be pursued against the borrower. So, don't think once your house is foreclosed and sold that the foreclosure is over.
